Terms of Use:

SIA “EVERGREEN”, REGISTRATION NO. 40103157649, LEGAL ADDRESS ‘Burtnieki’, Rembates parish, Ogre district, LV – 5016, hereinafter – the online store – provides the content available on the website and supplies goods/services in accordance with the Terms of Use set out below.

1. General Provisions

If the consumer purchases goods/services through the website, such mutual agreement shall be considered a Distance Contract and is subject to the laws of the Republic of Latvia governing distance contracts, including but not limited to the “Consumer Rights Protection Law of the Republic of Latvia,” the Cabinet of Ministers Regulations “Regulations on Distance Contracts,” etc.

2. Purchasing

The prices and specifications of the products sold in the online store are indicated next to the products.

To place an order, add the desired products to the shopping cart. Fill in all the required fields and choose the most suitable delivery method. The total cost of the order with delivery and the conformity of the selected materials will then be confirmed by email. Make payment for the purchase once your order has been confirmed and the invoice has been sent.

3. Payment Terms

The currency for transactions on the site is Euro. Purchases cannot be paid online. You can pay the invoice in a convenient way once your order has been confirmed and the invoice has been sent.

The personal data required to complete the order is sent only to SIA Evergreen.

The contract enters into force upon successful payment according to the invoice issued by SIA Evergreen. If, for any reason, the order cannot be fulfilled, the Buyer will be informed, and the paid amount will be refunded as soon as possible, but no later than 14 days after receiving the notification.

4. Delivery Terms

Goods are delivered to all European Union countries and, by mutual agreement, also to other countries worldwide. Purchased goods are delivered using parcel terminals, couriers, pickup from the Evergreen warehouse, or other logistics service providers. All duties and taxes payable to receive the shipment at the delivery destination must be covered by the Buyer. Delivery costs are displayed before the order is confirmed. Purchased goods are delivered to the Buyer’s specified address in accordance with mutual agreement. In exceptional cases, for individual orders, the delivery time may be up to 14 weeks, with the client being informed.

5. Right of Withdrawal

The Buyer has the right to withdraw from the goods before the order is confirmed. Before payment, the Buyer has the opportunity to verify the conformity of the goods, and after delivery, goods may be returned only by mutual agreement if the goods are defective or damaged in the manufacturing process.

The online store is not responsible for delays or non-performance of obligations caused by circumstances and obstacles beyond the reasonable control of the online store.

The online store reserves the right to refuse to sell goods and request the return of goods from the Buyer if the price indicated in the online store is significantly lower than the market price due to an error.

6. Consumer Rights Regarding Non-Conforming Goods

The online store is not responsible for defects arising after the delivery of goods to the Buyer. If the purchased goods have defects for which the Seller is responsible, the Buyer has the right to request the elimination of defects or exchange for new goods free of charge.

If the goods cannot be repaired or replaced, the Seller shall refund the Buyer all payments provided for in the Distance Contract.

7. Processing of Buyer’s Personal Data

The online store processes only the personal data entered by the Buyer when placing orders, such as name, surname, email, etc.

The online store transfers personal data to the delivery service provider(s) to ensure the delivery of goods.

8. Dispute Resolution Procedure

For issues not covered by these terms and conditions, the Buyer and the Seller undertake to comply with the laws and regulations in force in the Republic of Latvia.

The Parties shall resolve all disputes arising between the Seller and the Buyer through mutual negotiations or correspondence. If disputes cannot be resolved through negotiations or correspondence, the Parties shall settle the dispute in the courts of the Republic of Latvia in accordance with Latvian legislation. Disputes between the Buyer (consumer) and the Seller may also be submitted to the Consumer Rights Protection Centre or the courts of the Republic of Latvia.

The Buyer also has the right to apply to the dispute resolution institutions of the European Union.
